Why Title Insurance?
Title insurance protects against claims from defects in the title to the property. Defects are impediments to title such as others claiming ownership interest, improperly recorded documents, fraud, forgery, liens, encroachments, easements and other items that are specified in the insurance policy.
Unlike vehicle or homeowner’s insurance which protect against potential future events and paid in monthly or annual premiums, a title insurance policy insures against events which occurred during past real estate transactions or ownership. Additionally, there is a one-time premium for title insurance which is paid at the time of closing.
There are two types of title insurance:
- A lender’s policy protects the lender’s interests in the property and is generally required when a lender issues a mortgage loan. A lender’s policy does not protect the buyer.
- An owner’s policy, also purchased at closing, provides coverage for the purchasers’ ownership interest.
